XVIII. Discipline of Students with Disabilities
A. The Board recognizes that it may be necessary to suspend,
remove or otherwise discipline students with disabilities to address
disruptive or problem behavior.
B. The Board also recognizes that for students with
disabilities there are prescribed procedures whenever school authorities
intend to impose discipline upon them.
C. The Board is committed to ensuring that the procedures
followed for suspending, removing or otherwise disciplining students
with disabilities are consistent with §3214 of the Education
Law and Part 201 of the Regulations of the Commissioner of Education.
D. While the school has the authority to suspend or remove a
child for violating the school’s code of conduct, the parent and
child have certain rights throughout the process.
